In accessing our web pages, you agree that you may only download the content for your own individual and non-commercial use. The contract between us is governed by and interpreted in accordance with English law and the English courts have the jurisdiction to resolve any disputes between us. These terms and conditions do not affect your statutory rights.

Corker – Conditions of Sale

General

In these conditions:
‘We’ or ‘us’ means Corker Outdoor Ltd.

‘You’ refers to any person or entity buying our products.
‘Delivery’ is delivery by us or any subcontractor employed by the company directly or indirectly.

Any variation to these conditions, including the introduction of any additional terms, shall only be binding when agreed in writing by you and us. By making a purchase order online you agree to these conditions of sale.

Our Products

By making a purchase from us, you are contracting with us and are bound by these terms. No condition or warranty is given or implied by law, custom, usage or otherwise as to the quality or fitness for any purpose of the goods sold by us, unless stated in writing.

You understand that products are measured when packed and due to the nature of the products a degree of settlement will occur.

You understand that turf is a growing crop, which is an everchanging product dependent on the conditions of its growing environment. You understand that turf is a perishable product which must be laid on properly prepared topsoil. The turf must be rolled out and laid within a maximum of 2 hours from delivery, and it must be watered appropriately to encourage rooting.

We cannot guarantee that the appearance and/or colours of products shown on this site will exactly match the appearance and/or colours of the physical products themselves. Natural products may show some colour variations. All quoted sizes are approximate.

You understand that the materials are measured by a certified loading bucket which is stamped and measured by Trading Standards, and not by the dimensions of the bag it is delivered in.

All prices quoted by us include the cost of delivery, unless otherwise stated. You are required to pay by credit card/debit card at the time of ordering.

Prices quoted are inclusive of VAT and include standard delivery of usually 3-4 working days, unless otherwise stated. There are additional charges for next day and weekend deliveries.

Delivery and Acceptance of Goods

Delivery of products shall be completed on either: (a) us making the products available for collection at our business premises; or (b) on their arrival at the delivery address stated in your order and agreed by us (the “delivery location”). You may change the delivery location before the products are dispatched for delivery. We may then amend the delivery costs and/ or packaging costs (as defined in clause 5) as required, or cancel the contract without liability to you.

You will provide all information required to allow us to deliver the products. We will not be responsible for any delay or failure to deliver the products if you do not provide us with adequate, or provide us with incorrect, information (including delivery instructions), including in respect of any loss, cost, expense, damage, or other liability incurred by you as a result thereof. We will deliver to the delivery location provided there is a suitable road to the point where delivery is requested. If no such road exists, delivery will be made to the nearest point at which, in the driver’s reasonable opinion, the vehicle can safely and lawfully unload.

As a rule, delivery locally is made by Corker lorries and can be craned to any safe hard standing within reach of the lorry. Pallet delivery is made to kerbside only and will be unloaded from the back of the vehicle using a tail-lift (a platform that lowers down). The pallets are then rolled off the vehicle; therefore it is very important that the ground is level and hard such as tarmac or concrete. Grass, compacted soil and gravel are not suitable areas for unloading.

You understand that we can only guarantee delivery to kerbside or roadside and accept that goods will be left in this manner.
If you request delivery to somewhere other than kerbside, then you must be aware that this may not be possible and that you must take kerbside delivery in the face of this. We will not accept damage to property caused during delivery whereby you have instructed drivers for goods to be placed anywhere other than kerbside.

You understand that delivery onto a driveway is at the driver’s discretion and you therefore agree that the driveway can withstand the weight of at least 1 tonne and up to 18 tonnes if it is necessary for the unloading vehicle to drive onto the property to offload bags. We will never drive onto a driveway to deliver unless asked to do so by the customer

Our vehicles do not drive across fields or unmade roads. If you wish to have delivery across a field, you accept liability for any damage made to our vehicle. If the vehicle becomes stuck when crossing the field under your instruction, then you must arrange and pay for an immediate vehicle recovery. Our charge for a vehicle being held up in this manner is £50+VAT per hour.

If you wish for any vehicle to leave the public road and enter your property or premises of delivery then you accept liability for any damages caused to the property, vehicle or other. If we or our agent cannot gain access to the delivery address, you may incur additional costs. Deliveries are made using large vehicles and it is your responsibility to inform us about a potential access problem. We will confirm the outcome by e-mail. When in our opinion delivery is impossible, we reserve the right to cancel the order. This above action must be completed before 2.00 pm on the day prior to delivery.

It is also not possible to lift goods over any walls, fences, hedges etc. Crane offload is only available within a 20-mile radius of the Corker depot located near Paddock Wood, Kent, UK. Please see our Delivery page for more information.

You accept responsibility for providing a suitable area free from access restrictions for the delivery to be left. In some areas of the UK, it is your responsibility to obtain a permit from your local council to have bulk bags left on the kerbside.

Loose loads of product are delivered on a vehicle with a gross weight of 3.25 tonnes to 18 tonnes maximum. It is therefore your responsibility to find a suitable delivery point for loose product loads to be tipped off.

Please note, e-mail order confirmation also requests you to contact us if a delivery problem may occur.

If we attempt delivery and it is unsuccessful due to the lack of information provided by you, or your failure to read or consider delivery information and restrictions, then you will become liable for re-delivery charges and/or re-routing costs of £35 + VAT per pallet/bulk bag.

We reserve the right to cancel or hold any orders that in our opinion may suffer from potential delivery problems and you understand this may cause the delivery dates may be delayed.
If products are out of stock, then we also reserve the right to cancel or hold delivery of orders.

You, or somebody you appoint, should be present at the exact delivery location to accept the delivery.

You become responsible for the security and insurance of the products after the delivery has been made. After such time, we shall be under no liability for loss, damage, or deterioration of items from whatever cause arising.

It is your responsibility to move the compost, soil, or turf from the place of delivery to the area of use.

It is your responsibility to comply with all Health & Safety Legislation requirements.

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, or accident.
Our Premises

We accept no responsibility for injury or damage caused to persons or equipment whilst on our premises or your premises.

Order Changes

Any changes to your order must be made before the goods are dispatched. Dispatch may take place up to 5 working days before delivery. We are unable to amend orders after they have been dispatched.

Cancellation, Returns, and Complaints

You have the right to cancel any product or services at any time up to 7 working days, starting after the day of dispatch. If product has been delivered there will be a 30% re-stocking fee for unwanted items. Damaged or faulty items (including those that have been delivered incorrectly) will receive a full refund. We will issue the refund when we receive the returned goods, at your cost. In case the goods were faulty or damaged we shall cover return haulage.

Once the order is dispatched, it is your responsibility to return the goods at your expense if you wish to cancel your order.

If you wish to make a complaint, we require that you make it in writing using our Contact page within 48 hours of collection or delivery.

Privacy

Our website does not store your credit or debit card numbers.

Working Days

Working days are Monday, Tuesday, Wednesday, Thursday, Friday, except Saturday and Sunday.
